Last month, Judge Karen Gievers from Leon County Circuit Court ruled that Florida Legislature’s ban on smoking medical marijuana was unconstitutional. However, despite her Monday deadline for the state to establish a distribution system, patients are still legally barred from smoking their cannabis. 

This is because the Florida Department of Health requested a stay on Gievers’ ruling pending a review by the First District of Appeals. This means that the ban will remain in effect until more legal hurdles are cleared. 

In response to the move, the People United for Medical Marijuana filed a motion for immediate resolution with the Florida Supreme Court, to allow for the ban to be lifted until it goes to the state’s highest court, which could take months or even up to a year.
